The Arizona Residential Landlord & Tenant Act is not something I typically enjoy reading. It’s more something I read so I stay in the know! Sometimes I casually glance at it to refresh my memory about the laws, but I try to always read it every time it is revised or updated.
During my latest “read” I discovered something new – residential landlords must now add one more disclosure to their already long list of disclosures – and that is to disclosure Bed Bugs. (Incidentally, this is also a home buyer disclosure that must be made.)
“Bed Bugs: Bed bug infestations are on the rise in Arizona and nationally….” According to the Arizona Buyer advisory guide. The following websites will also give you as a landlord or home buyer more information about bed bugs – from preventing, to treatment, etc.
For tenants, the landlord has obligations with respect to bed bug disclosure, but you also have obligations to prevent bed bug infestation. This is a small section of the bed bug disclosure from the Arizona Landlord Tenant Act:
B. A tenant has the following obligations with respect to a bedbug infestation:
1. The tenant shall not knowingly move materials into a dwelling unit that are infested with bedbugs.
2. A tenant who knows of the presence of bedbugs shall provide the landlord written or electronic notification of the presence of bedbugs.
Reading further, the bed bug section states: The landlord and tenant of a single family residence are excluded from the provisions of this section.
